F-1 to H-1B: Making the Transition

How Indian F-1 students can transition to H-1B work authorization after graduation.

Overview

For most Indian students on F-1 visas, the ultimate goal is to transition into H-1B status and begin a U.S. career. This transition requires careful planning around OPT timing, the H-1B lottery, and the cap-gap rule.

For Indians Moving From India

If you graduated from a U.S. university, returned to India, and later found a U.S. employer willing to sponsor you, you will go through the H-1B lottery from abroad and undergo consular processing. Having a prior U.S. degree strengthens your petition.

For Indians Already in the US

The standard path is: graduate → apply for 12-month OPT → apply for STEM OPT extension (24 months) if eligible → enter H-1B lottery → if selected, transition on October 1st. For STEM graduates, the combined 36-month OPT window provides three full lottery opportunities.

Key Information

Students must register for the H-1B lottery in March of each year through their sponsoring employer. OPT must be applied for within 90 days before and 60 days after the program end date.

Requirements

A job offer from an employer willing to sponsor H-1B, an approved OPT EAD, and timely lottery registration by your employer.

Common Mistakes

Missing the OPT application deadline. Applying late can cost precious months of authorized work time and disrupt the H-1B lottery timeline. Starting work before the OPT EAD card arrives is also a serious violation.

Practical Tips

Begin your job search in your final academic year — ideally by September/October — so you have a job offer secured before OPT begins. Explicitly ask in interviews whether the company has previously sponsored H-1B workers.
