Understanding Lease Agreements

What Indian immigrants must know before signing a U.S. rental lease agreement.

Overview

A lease agreement is a legally binding contract between you and the landlord. It governs the rules of your tenancy, payment schedules, and the consequences of breaking the contract. Understanding it before signing protects you significantly.

For Indians Moving From India

Be prepared to sign a standard 12-month lease. Shorter leases of 3 to 6 months are available but typically come with a significantly higher monthly premium. Confirm the move-in costs before signing — first month, last month, and security deposit can total three months' rent upfront.

For Indians Already in the US

When your 12-month lease ends, you usually have the option to renew for another year (often at a slightly increased rate) or transition to a month-to-month agreement. Month-to-month provides flexibility but also exposes you to rent increases with typically 30 days' notice.

Key Information

Leases commonly include a security deposit (usually one month's rent) held by the landlord to cover damages beyond normal wear and tear. Review the rules around utilities, pet fees, guest policies, and maintenance request procedures before signing.

Requirements

Your physical or digital signature, and payment of first month's rent plus security deposit — typically via certified check or money order — before receiving keys.

Common Mistakes

Ignoring the early termination clause. If your visa situation changes and you need to leave suddenly, breaking a lease can cost thousands of dollars in penalties.

Practical Tips

Always conduct a move-in inspection. Take date-stamped photos or a video walkthrough of the entire apartment before moving furniture in, documenting every pre-existing scratch, stain, and fixture issue.
